These Terms of Service ("Terms") govern your access to and use of the website at getnubare.com and any products or services we sell (the "Services"), provided by NATURABELLE LLC ("nubare," "we," "us," or "our"). By using the Services or placing an order, you agree to these Terms. If you do not agree, do not use the Services.

A separate Messaging Terms of Service governs our SMS marketing program. A separate Privacy Policy governs how we handle your information.

1. Eligibility

You must be at least 18 years old to purchase from us. If you are under 18, a parent or legal guardian must place the order on your behalf and accept these Terms.

By placing an order, you represent that the information you provide is accurate, that the payment method belongs to you (or that you are authorized to use it), and that your purchase complies with all applicable laws.

2. Products and descriptions

We try to describe and photograph our products accurately. Colors may appear differently on different screens. Pack contents, shade ranges, and sizing recommendations are guidance only — fit varies by body, and you should consult our sizing guide before ordering.

We reserve the right to:

  • Limit quantities per customer or order
  • Refuse, cancel, or modify any order at any time before shipment (including for suspected fraud, pricing errors, or stock issues)
  • Discontinue products without notice

3. Pricing and payment

All prices are in US dollars and exclude applicable taxes and shipping unless stated. Prices are subject to change without notice; the price at checkout is what governs your order.

If a product is mistakenly listed at an incorrect price (whether due to typo, system error, or supplier error), we may cancel orders placed at the incorrect price even if the order has been confirmed and your payment method charged. We will issue a full refund.

We accept major credit cards, debit cards, and other payment methods listed at checkout. Payment is processed by our payment provider; we do not store full card numbers.

4. Orders, shipment, and delivery

Order placement is an offer; the contract forms when we confirm shipment by email. Shipping methods, transit times, and costs are described in our Shipping Policy.

Risk of loss passes to you once the carrier accepts the package for shipment. If a package arrives damaged or is lost in transit, contact us at support@getnubare.com within 30 days and we will work with the carrier on a resolution.

5. Returns, refunds, and the 30-Day Fit Guarantee

See our Refund Policy for full terms. In short:

  • First-order fit guarantee: if your first pair doesn't fit, you have 30 days from delivery to request a full refund of the order. You keep the inserts (we cannot restock items that have been against skin).
  • General returns: all self-adhesive inserts and intimate items are final sale due to hygiene.
  • Damaged or wrong items: report within 30 days for replacement or refund.

6. Suitability and use

nubare products are body-contact cosmetic accessories. They are not intended for individuals with sensitive or thin skin, or for those who are pregnant or breastfeeding. Suitability information and application guidance are provided on each product page and in our FAQ; please review them before purchase. If you have a known adhesive sensitivity, we suggest doing a patch test before first wear.

nubare products are not medical devices and are not intended to diagnose, treat, or prevent any condition. Use as directed. We are not liable for misuse or for individual reactions outside of product defect.

7. Marketing and communications

If you opt in, we will send you marketing emails and/or SMS. You can opt out at any time (see our Privacy Policy and Messaging Terms). Transactional messages (order confirmations, shipping updates, refund notices) will continue regardless of your marketing preferences because they are tied to your purchase.

8. Intellectual property

The Services, including all text, graphics, logos, images, photographs, design, code, and product names, are the property of NATURABELLE LLC or its licensors and are protected by US and international copyright, trademark, and other laws. You may not copy, reproduce, distribute, modify, or create derivative works of any part of the Services without our prior written permission.

If you submit content to us (reviews, photos, social tags, testimonials), you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, distribute, and display that content in connection with the Services, including in marketing.

9. Prohibited use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of these Terms
  • Reverse engineer, scrape, or attempt to access non-public portions of the Services
  • Use bots, automated tools, or scripts to place orders, abuse promotions, or extract data
  • Submit false, misleading, or fraudulent information
  • Resell our products without prior written authorization
  • Infringe our intellectual property rights or those of any third party

10. Disclaimers

THE SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT WHERE PROHIBITED BY LAW. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NATURABELLE LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL, OR DATA, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.

OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR PRODUCTS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE SIX MONTHS BEFORE THE CLAIM AROSE, OR (B) FIFTY US DOLLARS ($50). SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR EXCLUSION OF CERTAIN DAMAGES; IF THESE LAWS APPLY TO YOU, OUR LIABILITY IS LIMITED TO THE MINIMUM EXTENT PERMITTED.

12. Indemnification

You agree to indemnify, defend, and hold harmless NATURABELLE LLC and its affiliates from any claims, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of (a) your use of the Services, (b) your breach of these Terms, or (c) your violation of any law or third-party right.

13. Governing law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-laws principles.

14. Dispute resolution and arbitration

Please read this section carefully — it affects your legal rights.

Any dispute arising out of or relating to these Terms, the Services, or our products will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be held in Sheridan, Wyoming, or by video conference at the arbitrator's discretion. The arbitrator's decision is final and binding.

Class action waiver. You agree to bring claims only on an individual basis and not as a plaintiff or class member in any class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class proceeding.

Small claims exception. Either party may bring an individual claim in small claims court for disputes within that court's jurisdiction.

Opt-out right. You may opt out of this arbitration agreement by sending written notice to support@getnubare.com within 30 days of first agreeing to these Terms. Opt-out applies only to the arbitration section and not to any other part of these Terms.

If any part of this section is held unenforceable, the rest remains in effect except that the class-action waiver is non-severable — if it is held unenforceable, the entire arbitration agreement is void.

15. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including suspected fraud, abuse, or violation of these Terms.

16. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted with a new "Last updated" date. Your continued use of the Services after changes take effect means you accept the updated Terms.

17. Miscellaneous

These Terms (together with the Privacy Policy, Refund Policy, Shipping Policy, and Messaging Terms) are the entire agreement between you and us regarding the Services. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them at any time.
